JOLIET, Ill. -- The complicated re-trial petition hearing for Drew Peterson began Tuesday.
Peterson's attorney, Steve Greenberg, was on the 2012 defense team.
He said Peterson's former lawyer, Joel Brodsky, botched Peterson's defense.
Last year, Peterson was convicted in the 2004 bathtub murder of his third wife, Kathleen Savio.
Greenberg admits this is a last ditch argument for a new trial before Peterson's sentencing hearing.
Greenberg and Brodsky have sparred publicly over Peterson's call for a re-trial. Before court on Tuesday, Brodsky had Greenberg served with a defamation lawsuit.
Brodsky was called as a witness and testified that $25,000 for photos and videos were paid into a Peterson Trust Account that Brodsky had access to.
If the judge rejects the arguments for a re-trial, Peterson's case will move into the sentencing phase.
