Starting in January, tossing a cigarette butt out your car window could result in jail time.

Cigarettes have been added to the definition of litter under the Illinois Litter Control Act. That means if you toss a butt, lit or not, it is a class B misdemeanor.

Get caught a second time, and you can be charged with a class A misdemeanor. If you're caught for a third time, you can be charged with a class 4 felony and put behind bars for up to three years.

The law goes into effect January 1, 2014.
