Jurors not in court as attorneys fight over taped Harris interview

PEORIA, Ill. -- Jurors did not return to the courtroom Monday in the murder trial of Christopher Harris as attorneys spent the day arguing over a police interview of Harris.

Defense attorneys objected to showing the taped interview to jurors on Friday.

Monday, the defense submitted a motion to suppress the video based on a statement Harris made during the interview.

The defense attorney said while Harris was told that he was not under arrest, police had already decided they were going to arrest him and evidence gathered during that time should be thrown out.

Harris himself took the stand and testified that he was read his Miranda rights but waived them and continued answering questions.

Defense attorney's withdrew the motion.

The jury is expected to return Tuesday.
