Decision delayed on Rutherford lawsuit

CHICAGO, Ill -- A Federal Judge has delayed a decision about granting Illinois Treasurer Dan Rutherford's request to throw out a lawsuit filed against him by a former employee.

Rutherford's attorney asked for the lawsuit by former employee Edmund Michalowski to be dismissed. Judge Joan Lefko instead gave Michalowski's lawyers a month to respond.

Michalowski's lawyer says the motion to dismiss was meaningless.

"A lay person may not understand the inner workings of this, but this is standard operating procedure," said Christine Svenson, Attorney for Michalowski. "We expect to defeat the motion to dismiss and go on to discovery."

Rutherford's attorneys have suggested that Michaelowski's lawsuit was politically motivated, coming in the middle of the primary race for Governor.
