PEORIA, Ill. -- Peoria City Councilman Gary Sandberg is appealing the decision of the Peoria Elections Commission that removed him from running in the First District.
The Commission ruled against Sandberg citing a section of the Illinois Municipal Code which requires an "Alderman" to live in his "ward" for a year before running for office.
But Attorney Robert Hanauer argued in his appeal that the Commission was looking at the wrong section of the municipal code.
Hanauer said the proper section concerning council/manager city governments only requires residency in the municipality for a year.
The civil lawsuit seeks to prevent the printing of city election ballots until after a judge's ruling is made.
A hearing is expected within 30 days.
