KNOX COUNTY, ILL -- Sheley had been convicted in Knox County for destroying a chair in the courthouse and throwing parts of it at deputies.

Sheley had wanted to represent himself, but Knox County Circuit Court Judge Steve Mathers denied that request.

The Illinois Appellate Court now says Mathers should have allowed Sheley to represent himself, since a state psychologist had told the court that Sheley was not incompetent.

Now, if the Knox County prosecutor chooses to prosecute, Sheley will be returned for a retrial.

Since his assault conviction, Sheley has been convicted of murder in Knox County.
